The use of our website/product (https://charlotte-gush.mykajabi.com/) is subject to these Terms & Conditions. By using website/product you (user) expressly agree to adhere to the provisions contained herein. In case you do not agree to any of them, we kindly ask you not to use our website/enroll in ‘Shaman’s Hearth & Library’. 

USE OF THE WEBSITE/PRODUCT

This website/Product is owned and operated by Charlotte Gush - Shamanic Way - Shaman's Hearth & Library, Weymouth, Dorset, DT4 0SP (“we”, “us”). All content featured or displayed on the website, including all text, graphics, photographs, images, moving images, sound, illustrations and software, and all related rights, are the exclusive property of us or persons who have granted their permission to display the content on the website. All elements of the website are protected by copyright, trademark, moral rights and other laws relating to intellectual property. By accepting these Terms & Conditions, you are granted a revocable license to access the website. 

EXCEPTIONS AND RESTRICTIONS

You will not, sell any of the Product (or any part of it) to any third party; Distribute any document template, information or other item in the Product (or any part of it) to any third party for sale or resale (or free of charge) either as part of a package or as a separate product.

You will not use the Product (or any part of it) for any purpose, rivalling or competing with our business. If there is a dispute between You and Us, we will have the right to define "rivalling" and/or "competing" purposes.

You will not rent, lease, sub-license, or loan any of the Product (or any part of it) to any third party.

We are and will remain at all times the sole owner of the copyright and all other intellectual property rights in the Product.

All licenses, consents, and restrictions in these Terms and Conditions will last for the normal duration of copyright in literary works as defined in Section 12 of the Copyright

Designs and Patents Act 1988 (the life of the author, plus 70 years). Except as expressly stated in these Terms and Conditions, nothing else allows you to use, or gives you a right to allow use of, any part of the Website or any Product, or allows you to sublicence or give a right to sublicence any part of the Website or any Product or any intellectual property rights therein.

REGISTRATION

Features of our website/product are only available to the registered users. If you want to access the website, please create an account by providing us with your email and create a password.

FEES AND PAYMENT TERMS

Features of our website/products are only available on paid basis. All Fees on the Website or quoted by us exclude Value Added Tax. Stripe, Inc. handles all transactions on the Website. We do not collect or process your payment details.

Once you have made payment, your Subscription Period begins (12 months). You will have the right to access the Product/Paid Content (or the relevant part of the Product as determined by your subscription) for the whole of the Subscription Period. By accessing (e.g. viewing, downloading or streaming) the Paid Content within the 14 day ‘cooling-off period’, you will lose your legal right to cancel if you change your mind.

Your Subscription period is 12 months & will automatically renew annually until you cancel your subscription/amend automatic renewal setting. You will be notified of annual renewal 30 days prior to renewal.

PROVISION OF PAID CONTENT

In some limited circumstances, We may need to suspend the provision of Paid Content (in full or in part) for one or more of the following reasons:

  • To fix technical problems or to make necessary minor technical changes.
  • To make more significant changes to the Paid Content.
  • If We need to suspend availability of the Paid Content for any of the reasons We will inform you in advance of the suspension and explain why it is necessary (unless We need to suspend availability for urgent or emergency reasons such as a dangerous problem with the Paid Content, in which case We will inform you as soon as reasonably possible after suspension).

SUBSCRIPTIONS, PAID CONTENT, PRICING AND AVAILABILITY

We make all reasonable efforts to ensure that all descriptions of Subscriptions and Paid Content available from Us correspond to the actual Subscription and Paid Content that you will receive. Please note, however, that due to ‘The Shamanic Hearth & Library’ being hosted by a third-party site (Kajabi.com) we are unable to address accessibility issues related to Kajabi provision or faults.  

PROHIBITED USE OF THE WEBSITE

You are prohibited from using the site or its content: 

1. for any unlawful purpose; 

2. to solicit others to perform or participate in any unlawful acts; 

3. to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; 

4. to infringe upon or violate our intellectual property rights or the intellectual property rights of others; 

5. to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; 

6. to submit false or misleading information; 

7. to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the website, other websites, or the Internet; 

8. to collect or track the personal information of others; 

9. to spam, phish, pharm, pretext, spider, crawl, or scrape; 

10. for any obscene or immoral purpose; or 

11. to interfere with or circumvent the security features of the website or any related website, other websites, or the Internet. 

We reserve the right to terminate your use of the website for violating any of the prohibited uses.  

INDEMNIFICATION

You agree to indemnify, defend and hold harmless us and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms & Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

We do not want to receive any confidential or proprietary information from you through this website. Please note that any information sent to us will be deemed as non- confidential. Your information will never be sold to a third-party but is subject to Kajabi Terms & Conditions & subject to restrictions placed by our Privacy Policy.  

TERMINATION

We may suspend your access to the website and/or terminate these Terms & Conditions at any time if 

1. you are deemed to be an infringer of intellectual property rights; 

2. you are in breach of any of the material provision of these Terms & Conditions; 

3. We elect at its discretion to cease providing access to the website in the jurisdiction where you reside or from where you are attempting to access the website, or 

4. in other reasonable circumstances as determined by us at our discretion.

APPLICABLE LAW AND CONFLICTS RESOLUTION

These Terms & Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation, shall be governed by, and construed in accordance with, the laws of England. Each Party irrevocably agrees that the courts of England shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms & Conditions or its subject matter or formation.
